THE TEXT BELOW COVERS YOUR OBLIGATIONS WHEN IMPORTING ITEMS YOU HAVE PURCHASED, YOUR RIGHTS TO RETURN, AND THE NON LIABILITY AND NON RESPONSIBILITY OF THE SELLER REGARDING THE USE OF THE ITEMS YOU HAVE PURCHASED.
 
A. Responsibilities of Buyer and Seller - Shipping
 
 
1. Regarding shipping to addresses within the EU / CH / FL.
 
Shipments within the EU will be shipped to you from the EU and are not subject to import regulations. However, eBay will charge VAT on items priced below EUR150. This is an eBay decision and sellers have no influence on that.
Shipments within the EU are normally not subject to customs procedures or additional charges related to customs.
 
2. Regarding shipping to addresses outside of the EU / CH / FL.
 
By placing your order, you agree with the following regarding the import of the listed items into the country of your delivery address.
 
Rogier van der Heide or Curiosity Group GmbH , hereafter also “the seller” is responsible for packaging your item properly, creating shipment documentation by means of an Air Waybill, a Packing List, an Export Announcement and a Commercial Invoice, all as much as required by law, adding the Harmonized HS Code of the World Customs Organization to the shipment s documentation, arranging shipping insurance if agreed so with the buyer, informing the shipping company if lithium batteries are included in the shipment, passing the amount you paid for shipping service on to the shipping company, having the shipment collected for export, and sharing the shipment s tracking number with you as soon as the shipment is handed over to the shipping company.
 
As the buyer of the item(s) in the eBay listing from where you were linked to this document, you are responsible for providing an address where your purchase can be delivered and for the fulfilment of all customs procedures and import documentation related to the shipment, as required by the country of your delivery address.
It is also your responsibility to pay any duties, charges or taxes related to the import of the items into the country of your delivery address.Before you order, make sure that you are informed, and that you are allowed to import the item(s) into the country of your delivery address.
 
The seller Rogier van der Heide or Curiosity Group GmbH is not responsible for any import charges, duties, taxes or fees, if any, that are associated with importing the items or the shipment into the country of your delivery address. The payment of these charges in full is the buyer s responsibility.
 
The seller Rogier van der Heide or Curiosity Group GmbH is not responsible for any shipping delays caused by import or by customs procedures or other circumstances or happenings during shipping. The seller is not responsible either for confiscation, disposal or destruction of your purchase by any customs office. These are all no reasons for you as the buyer to request a (partial) refund of the price you paid to the seller.
 
Items that the shipping company returns to sender.
The seller is not responsible when the shipping company decides to return your purchase to the sender for reasons of you as the buyer having failed to arrange import, or because your purchase could not be delivered to the address you have provided to the seller.
If the return shipment is delivered to the seller within 30 days after it was originally shipped to you, you may apply for a refund by sending a message to the seller via eBay messaging. The refund will be equal to the original purchase price minus original shipping costs and minus 15% eBay charges and minus the cost of the return shipment including any customs charges, duties or levies.
If the return shipment is delivered to the seller more than 30 days after it was originally shipped to you, you are not eligible for any refund and in that case you lose your purchase. You may open a case with eBay so they can investigate and make a decision.
 
Get informed before you purchase. Contact your local customs office, and contact the shipping company s office in the country of your delivery address as soon as you have received the shipment s tracking number from the seller.
No-liability and no-responsibility of the seller regarding batteries, drones and drone accessories.
 
B. LIABILITY
 
Our products are often used (“second hand”), but sold as functional. If you have nonetheless received an item in a non-functional or partly-functional state, you have the right to return it within 30 days after the date you purchased it.
 
 
Rogier van der Heide or Curiosity Group GmbH, hereafter also “the seller” is not responsible for:
 
 
Any damage caused by batteries to your drone, any damage caused by failing batteries during flight and subsequently any damage caused by the drone that was powered by the batteries, in particular but not only when your drone crashes as a result of failing batteries, or any other damage caused by flying your drone with our batteries. The proper functionality of flight batteries is a function of maintenance, technical care, temperature, battery management, charging technology, compatibility with the drone, and many more factors that are completely outside of the control of the seller, which why the seller is not responsible or liable in any form or kind in case of failing batteries during flight.
 
 
The fitness to fly of any batteries you have purchased. You are obliged to inspect the batteries you have purchased immediately upon delivery. The decision to fly or not to fly with the batteries you have purchased is solely your responsibility. If the batteries are not functional or if they are damaged other than wear from normal use* then you are obliged to inform the seller immediately, so the return of your batteries can be arranged. Do not attempt to fly with batteries that you consider not fit for flying. When in doubt, do not fly and contact the manufacturer to get expert advice regarding the state of your batteries.
 
 
Any damage caused by a drone you have purchased from the seller, or caused by flying any drone with an accessory you have purchased from the seller. The seller is not liable in case of collisions of the drone, crashing of the drone, the drone failing to fly or to continue flying, damage to the drone itself, water damage to the drone, or any other damage caused by using the drone regardless of the skills, the license or the permits of the pilot. The seller is not responsible and not liable for any consequences of the use of the product sold to you. In most countries, liability insurance that covers the operations of drones is compulsory. It is highly advisable to inform yourself in regard to this before flying your drone or your drone accessory for the first time.
 
C. RETURNS
 
If the listing states the item may be returned, then you may return your item within 30 days after the purchase date, but only if the item is non-functional or and only if the return has been agreed upfront with the seller.
Wear from normal use* is not a reason to return the item
Having changed your mind about your purchase is not a reason to return the item
Use eBay Messaging to ask the seller for details of the item before you decide to purchase it!
Inspect your purchases immediately after delivery and contact the seller if you think something is not functional.
To return, contact the seller on eBay Messaging and request the return. The seller will first work with you to see if the non-functionality of your item can be solved. If it cannot, the seller will agree with the return and you can proceed with it.
As the buyer of the product, you pay the postage of the return shipment and you are responsible for the delivery of the return shipment at the return address of the seller
If your return contains batteries, either separate or built-in to a device, make sure that you are permitted to ship these or your return shipment may be delayed or confiscated or destroyed by authorities.
On the customs papers, you clearly indicate the shipment is a return. As the incoterm for your return shipment you choose “DDP”. Ask the seller for help if in doubt. If you do not fill out the customs paperwork correctly, you risk that import duties and / or import tax will be charged and these will be deducted from the amount refunded to you.
Once the seller has received your return shipment, it will be inspected and the seller will contact you to either agree on a refund or an exchange of your purchase.
 
 
*wear from normal use includes scratches, small dents, stains, worn surface coatings, faded labels, discoloration due to sunshine or other influences, and so on. As much as possible, the seller will publish photos in his listings to illustrate the signs of normal wear.
