Nach der Darstellung der oekonomischen Grundlagen des Hedging analysiert die Autorin die Moeglichkeiten der Widerlegung der Nutzungsvermutung von Insiderinformationen bei Hedging-Geschaften durch die neu normierten legitimen Handlungen und die bereits bisher anerkannten Fallgruppen. Im Hinblick auf Sinn und Zweck des Insiderhandelsverbots und die Erkenntnisse der Behavioural Finance eroertert sie die Moeglichkeit einer ungeschriebenen Hedging-Ausnahme. Zudem beleuchtet sie insiderrechtliche Fragen in Bezug auf einzelne Hedging-Strategien.
