The actual minifigure sent to the buyer was correct exactly as shown in the listing. Return postage costs were not 'unequivocally' the sellers responsibility - in fact the listing terms state that the buyer pays return postage costs. The last comment is simply just not true - the buyer made no such requests. Further, eBay policy states that "sellers seller is responsible for return postage costs" when they have sent wrong item. As for seller stating the "buyer made no such requests", I provided evidence of 4 messages requests sent (photo of my ebay message screen) that were not responded to.
