TERMS AND CONDITIONS
1.0 ABOUT US
1.1 Shoxitech is operated by Shoxitech Ltd, registered in England with company number 12539012 whose registered office is Initial Business Centre, Monsall Road, Manchester, England, M40 8WN. The goods you buy from Shoxitech will be purchased from Shoxitech Ltd.

1.3 These Terms and Conditions and transactions relating to the marketplace are governed by English Law and are subject to non-exclusive jurisdiction of the English Courts. We do not accept amendments to these terms and conditions.
2.0 YOUR STATUS
2.1 By placing an order, you warrant that:
(i) You are legally capable of entering into binding contracts; and
(ii) It is an offence to attempt to buy a certified title if you are under the required age or to attempt to purchase any such title on behalf of an underage third party.
(iii) You are resident in the UK (unless ordering through the Global Shipping Programme); and
3.0 OUR CONTRACT
3.1 After placing an order you will receive an order confirmation that we have received your order. Please note that this is not acceptance of the order. Your order is an offer to us to buy the product. All orders are subject to acceptable by us, and we will confirm acceptance by sending you a dispatch confirmation email. The contract between us will only be formed when we send you the Dispatch Confirmation. Any accounts suspected of fraudulent activity will have their orders cancelled and accounts blocked and reported to eBay.
4.0 QUALITY OF REFURBISHED PRODUCTS (USED PRODUCTS)
4.1 You acknowledge that products sold by Shoxitech Ltd that are advertised as ‘refurbished’ will be pre owned products. We will thoroughly check the products we sell and warrant that the condition of the product will match the grading description related to that product as stated in the marketplace listing.
4.2 THE GRADING DESCRIPTION IS SET OUT BELOW:
(i) Grade A - (Like New): The product is in a like new condition and is either a new product returned within 14 days (used or not used) with minor signs of use.
(ii) Grade A - (Very Good): The device is in an exceptional condition showing little or minor signs of use such as micro scratches invisible at 20cm.
(iii) Grade B - (Good): The device is in a very good condition showing light signs of use such as minor scratches/marks, dents and previous owner engravings on the rear casing.*
(iv) Grade C - (Fair): The device is in a average condition showing signs of wear and tear and may include deep scratches, dents, chips, marks or previous owner engravings on the rear casing.
*Apple iPods with a rear stainless steel housing will show more signs of use than other devices and as such may include imperfections such as scratches, chips or scuffs dependant on the grade. The screen will match the overall grading of the device.
4.3 Every device has been checked against the National CheckMEND register which identifies phones that have been lost, stolen, blocked or barred with a 'red flag'. We will only sell devices with a clean history on CheckMEND and a report for each device can be produced on request, and will be produced with every sale.
5.0 PRICES AND PAYMENT
5.1 All our prices are in UK pounds (any euro prices are converted by Web interpret/ PayPal ex rate who translate all our listings). The total cost of your order will be the price of the products you order, the delivery charge (if any). If you wish to choose a special shipping request such as Saturday guaranteed at our discretion, we can invoice you for this service.
6.0 DELIVERY AND COLLECTION
6.1 All UK orders are sent using either DPD, UPS, DHL or Royal Mail fully tracked services. Orders will be processed the same working day (if placed before 13:00).
6.2 It is your sole responsibility to ensure that the address details provided in your eBay and PayPal account are valid, accurate and correct and you accept and agree that we shall not be liable for any loss of any kind that you may incur due to Items being returned by us to an invalid or incorrect address as a result of your failure to provide valid, accurate and up to date address details. Please be aware that your Item will only be delivered to the address that you provide.
6.3 If your Item is not delivered when expected by our courier, you must notify us within 14 days of the agreed delivery date. If you fail to notify us of non-delivery within 14 days we shall not be liable for any loss or damage incurred as a result of non-delivery.
6.3 We shall be entitled to make such investigations as we deem necessary to satisfy ourselves of the validity of any such claim and will liaise with the relevant carrier to confirm if non-delivery has occurred.
7.1 We do not accept returns or exchanges unless the item you purchased is defective. If you receive a defective item, please contact us at with details of the product and the defect.
7.2 If purchasing online you have the right to cancel your order at any time within 14 days of receiving your item as long as the device has not been connected. If you wish to exercise this right to cancel you can do so by contacting us through eBay messaging and we will provide you with details of how to return the device to us. Please DO NOT return the item without first contacting us. All returned items must be returned in its original condition, all pass-codes and iCloud accounts must be removed from the devices before returning it.
7.3 It is your responsibility to make sure the device is appropriately packaged when you return it to us and we also recommend that you use an insured tracked service and obtain a proof of postage document. Please make sure to include all items in the original packaging. We do not accept any responsibility for orders until they are received at our returns address. We will not refund you if the device is damaged or lost in transit.
7.4 Once the item has been received and verified, a refund of the purchase price and any taxes paid will be issued through the original payment method. Please note that we will only refund you the standard delivery postage costs and you are responsible for the postage payable to return the device to us.
7.5 It is your responsibility to ensure that the device reaches us in the same condition as how you received it. If the device is returned in a different condition, we may reject the return or deduct the cost of the damage from the return.
7.6 If the device purchased was listed as ‘new’ and returned in a used condition such as by activating the device or installing the device we may make a deduction from the refund if the value of the goods has been reduced as a result of you handling the goods more than was necessary.
7.7 All devices must be restored to the factory settings and iCloud unlocked. Failure to do so will void the return.
8.0 FAULY PRODUCTS
8.1 If the product is faulty within 30 days of receiving your order, you must notify us immediately, stop using the device and report the problem to us through eBay messages. Once the item has been received and verified, a refund of the purchase price and any taxes paid will be issued through the original payment method.
8.2 If the product is damaged we will not issue a refund and defend any case brought against us through eBay and subsequently report the fraudulent return to eBay, PayPal and Action Fraud.
8.3 Although certain devices are classes as IP67 Rated, water damage will not be covered under our warranty for any device purchased from us. Use in or around water is up to the user and no liability will be taken for us should any water damage occur during its use in a liquid.
9.0 MISSING ITEMS
9.1 It is our responsibility to make sure all orders are dispatched along with the agreed accessories.
9.2 It is your responsibility to report to us any missing items within 14 days of receipt through eBay messaging.
9.3 All orders are packaged under CCTV and IMEI/Serial numbers logged and fully tracked for each order for audit purposes.
10.0 OUR WARRANTY
10.1 We are proud to offer all our customers with a 12 month warranty from the date of purchase on most devices. Our 12 month warranty applies where the device you purchase develops a manufacturer fault within 12 months of the date of purchase.
10.2 The buyer is eligible to one repair or replacement for an eligible fault listed under section 10.3; the buyer is not eligible for any repair or replacement for an excluded faults listed under section 10.4 and any associated claims will be rejected.

10.4 Excluded faults
10.4.1 Fingerprint sensor
10.4.2 Kill switch activation
10.4.3 Device does not turn on
10.4.4 Water damage
10.4.5 Malware, viruses or software faults
10.4.6 Battery, charger or charging port after 30 days from the date of delivery
10.4.7 Accidental damage
10.4.8 If the product has been used for commercial or business
10.4.9 Cosmetic damage such as scratches, chips, dents or corrosion Data loss
10.4.10Deliberate damage or neglect of the product
10.4.11 Any loss suffered as a result of not being able to use the product, or any loss over and above the purchase price of the original item
10.5 Our warranty does not apply to damage or problems with the device which are a result of your treatment of the device including any accidental damage and it is void if you have opened the casing of the device.

10.7 Where our 12-month warranty is approved you will be requested to send the item to our return address listed under section 1.1. It is your responsibility to make sure the device is appropriately packaged when you return it to us and we also recommend that you use an insured tracked service and obtain a proof of postage document. Please make sure to include all items in the original packaging. We do not accept any responsibility for orders until they are received at our returns address. We will not approve a warranty claim if the device is damaged or lost in transit.
10.8 Where our 12-month warranty is approved and authorised at inspection, we will offer the buyer a repair or replacement. The outcome of each claim is dependent on the outcome of the device inspection. You will also be reimbursed for the return cost to the value of up-to £4.00 for items valued at under £100 and £8.00 for items valued at over £100.
10.9 Where our 12-month warranty claim is approved for inspection as the buyer states the fault is an eligible fault listed under section 10.3 and rejected at inspection as the fault was determined to be an excluded fault listed under section 10.4 the buyer will be notified in writing of the reasons for rejecting the claim and issued an invoice for the return of the product. All future claims will be rejected.
10.10 Where our 12-month warranty claim is rejected as the buyer states the fault is an excluded fault listed under section 10.4, we will notify you in writing of the reasons for rejecting the warranty claim. All future claims will be rejected.
10.11 We will not issue a refund after 30 days. The outcome of each claim is dependent on the outcome of the device inspection.
10.12 Any warranty claims that are refused following inspection the customer will be required to pay 10% of the original order amount for an inspection fee and shipping costs to return the device.
10.13 To raise a warranty claim, you must contact us through the relevant marketplace or from the contact details listed in section 1.1.
11.1 We do not share any of your information with any third parties unless required to fulfil the order such (such as with a courier).
12.0 RISK AND TITLE
12.1 The products will be at your risk from the time of delivery and ownership of the ordered products will only pass to you when we receive full payment of all sums in respect of the order.
13.0 OUR LIABILITY
13.1 We warrant to you that any product purchased from us through eBay has been fully tested and is of satisfactory quality and reasonably fit for all the purposes for which the products are intended and supplied.
13.2 Our liability is strictly limited to the purchase price of the product you purchased for any losses you suffer as a result of us breaking this agreement.
13.3 We are not responsible for indirect losses which happen as a side effect of the main loss or damage, not foreseeable by you and us.
14.0 FRAUD PREVENTION
14.1 Shoxitech Ltd is committed to preventing, detecting and reporting fraud, and in co-operating with other organisations such as eBay, Action Fraud and the Police we will work to reduce opportunities of fraud. All orders are packaged under CCTV and IMEI/Serial numbers logged for audit purposes. We take all matters of fraud very seriously.

15.2 You and your refer to the purchaser.
15.3 Goods means any goods, products, or services you order from us
15.4 Order means an order placed by you with us for the purchase of goods.
15.5. Marketplace means the marketplace eBay.co.uk (eBay (UK) Limited), ebay.com (eBay Inc/eBay Canada Limited) or OnBuy.com (Visor Commerce Ltd).
