British Red Cross eBay Shop Consumer Terms and Conditions
We are The British Red Cross Society (“we”, “us” and “our”), incorporated by Royal Charter 1908. The British Red Cross Society is a charity registered in England and Wales (220949), Scotland (SC037738) and Isle of Man (0752). Our registered address is British Red Cross, UK Office, 44 Moorfields, London EC2Y 9AL. Our VAT number is 706926227
These Terms will apply to any contract between us for the sale of Items to you (“Contract”). Please read these Terms carefully and make sure that you understand them, before ordering any Items from the British Red Cross eBay shop. Please note that before placing an order you will be asked to agree to these Terms and by competing a purchase you are agreeing to these Terms. If you refuse to accept these Terms, you will not be able to order any Items from the British Red Cross eBay shop.
We amend these Terms from time to time. Every time you wish to order an Item, please check these Terms to ensure you understand the terms which will apply at that time. Every time you order Items from us, the Terms in force at the time of your order will apply to the Contract between you and us.
How the Contract is Formed Between You and Us
After you place an order for an Item, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted.
We will confirm our acceptance to you by sending you an e-mail that confirms that the Items have been dispatched (“Dispatch Confirmation”). The Contract between us will only be formed when we send you the Dispatch Confirmation.
Payment Options Accepted
The British Red Cross eBay shop can only accept PayPal payments. We do not offer any other payment and do not offer cash on collection. We apologise for any inconvenience.
Payment Time Allowance
The British Red Cross eBay shop is happy to wait a total of seven (7) days for payment of any Item. On day eight (8) if your Item has still not been paid for, our unpaid item assistant will unfortunately automatically open an unpaid item case. Please either pay or inform us if you would like to cancel your transaction to avoid any case marks against your eBay account.
Collection and Delivery
The British Red Cross eBay shop allows five (5) working days for dispatch but Items are usually shipped within (two) 2 working days of confirmed payment. Delivery estimates are based on the postage time from Dispatch Confirmation.
Items are usually dispatched within 3 working days either via Royal Mail or courier. Delivery estimates are worked out at shipment time plus delivery time and can be provided on request.
Please contact us prior to leaving low detailed seller ratings for late delivery; as this penalises the eBay account and not the carrier of the parcel.
Collection in Person
The British Red Cross eBay shop is unable to offer collection in person on any Items that are not specifically listed as 'Collect in Store' from a named High Street Shop. We sincerely apologise for any disappointment or inconvenience. For 'Collect in Person' listings collection should be carried out within fourteen (14) days of the auction ending.
Collect In Store Items - Collection, Payment and Delivery
All 'collect in store' Items will be clearly advertised on the listing as collection or British Red Cross delivery only. All Items must be paid for via PayPal prior to collection / delivery and thus cash on collection is unfortunately not a payment option. Collection must be done within the applicable Store’s opening hours unless prior approval from the applicable Store has been granted. Items should be picked up within fourteen (14) days and will not be held for longer than 21 days without approval from the applicable Store. Where Items have not been collected by you in within the stated timeframe for collection and the applicable Store has not had any contact with you, the Item will be refunded and re-listed for sale to another potential buyer.
Collect In Store Items - Booking Your Own Courier
We strongly advise against booking your own courier but understand that sometimes there is no other way. This said British Red Cross reserve the right to allow or refuse you booking your own courier for each individual Item. Permission from the applicable Store should be obtained beforehand if you expect the Item to be packaged for transportation. Please note that British Red Cross eBay shop and the Stores are never liable for insufficiently packaged Items as Store staff are not trained to package up Items to a high standard and do not have access to the correct packaging materials in Store as they are a high street retail outlet. Neither the British Red Cross eBay shop nor the Stores are able to book couriers on behalf of customers and do not take any responsibility for any loss, damage or other problems caused by privately booked courier services. Please note that in booking an independent courier you are accepting these Terms and take full responsibility for the delivery of the Item. In the event of loss or damage to the Item, you are to claim compensation from the courier only. Please note that in the majority of cases we will also not be liable for paying for a return courier service should you no longer want the Item. We thus advise, where possible, to use [collection or] the British Red Cross van services that we offer.
The British Red Cross eBay shop is happy to offer combined shipping wherever possible. Items can be combined where requested:
We can combine UK Items into one parcel weighing where practicable. Larger orders will be split into as few parcels as possible and will be charged accordingly.
We can combine worldwide Items weighing no more than 2kg via International Standard depending on size, weight and location.
Orders exceeding 2kg will be split into as few parcels as possible and will be charged based on weight, size and location.
The British Red Cross eBay Shop is unable to alter custom labels to help avoid tax or problems in other countries. We are unable to process any requests to label an Item for less than it is worth or to list the package as containing goods that it is not (including as a 'gift').
The British Red Cross eBay shop shall not accept responsibility for delays in delivery of Items due to customs where it has not been caused directly by an incorrect customs declaration made by us. The British Red Cross eBay shop shall not be liable for any problems encountered with customs during the returning of goods to us. You must comply with all applicable laws and regulations of the country from which the Item is being returned before returning an Item to us, you are responsible for your Item's safe return to us. Please note this means that we do not accept responsibility for any charges or extra charges incurred and will not issue compensation due to custom related issues where it is not directly our fault (i.e. a problem caused directly by a customs form completed by us at our premises). We apologise for any inconvenience or disappointment this may cause.
Opening up Auctions to International Buyers or Blocked Buyers
The British Red Cross eBay shop is unable to open up auctions to excluded buyers or countries once an auction has begun. If international shipping is not allowed on an Item, unfortunately we will not be able to ship that Item outside of the United Kingdom, regardless of whether you have purchased such an Item.
Offers to End Auctions Early
The British Red Cross eBay shop promises to not end auctions early or accept offers. It is the British Red Cross eBay policy to let all auctions run their course and be fair to all customers and supporters.
Cancellations of Bids or Auction Win
The British Red Cross eBay shop is happy to cancel bids or auctions as long as we are notified within three (3) days of bid/auction. We do request that the cancellation request is made promptly so that we may reclaim our fees and get the Item re-listed and re-sold as quickly as possible.
How we use your personal information
The British Red Cross eBay shop is open to respond to enquiries between 9:00 to 17:00 Mondays to Fridays. Please note all questions and cases will only be responded to within these times. We will aim to answer queries where possible within seventy-two (72) hours from receipt.
Policy on Buyers
The British Red Cross eBay shop reserves the rights to block or end communication with any abusive buyers, any buyers who do not follow proper eBay or PayPal
etiquette or any buyers which do not follow eBay or PayPal buying policies properly.
Please address any complaints you have to our customer service team via eBay message. Your feedback and satisfaction is very important to us but please do remember to contact us about lost parcels and other queries prior to leaving feedback, open cases or complaining. Complaints will be reviewed and responded to within five (5) working days.
Please also contact us prior to leaving low detailed seller ratings for late delivery; as this penalises the eBay account and not the carrier of the parcel.
The British Red Cross eBay shop accepts returns within fourteen (14) days in accordance with eBay returns policy.

IMPORTANT: Please refer to our returns policy below before returning any Item to us. Thank you.
Returns with Item Return
The British Red Cross eBay shop wants its customers to be happy with their Item. Thus, we accept all returns within 14 days of receipt of the Item for a full refund (Item plus original postage costs) as long as the Item is not in a worse / unsalable condition than sold, through no fault of transit. If your Item is in a worse condition than sold, please contact us prior to returning. Please note in most cases the buyer is responsible for return postage costs in accordance with eBay’s selling and buying policies. Returns can be processed through eBay message, eBay returns or if necessary, eBay resolution centre.
Returns between fourteen (14) and thirty (30) days, must be sent only with prior approval from the customer service team and will be entitled to a refund of the cost of the Item only. Again, in most cases the buyer is responsible for return postage costs in accordance with eBay’s selling and buying policies. Returns can be processed through eBay message, eBay returns or if necessary, eBay resolution centre. Returns through the resolution centre can be accepted for up to 45 days from purchase only where you believe the Item does not accurately match the description. Refunds for Items not received by the buyer can also be processed for up to 45 days from purchase through the resolution centre.
If you think you are entitled to a return postage refund as listed below, please contact us before returning your Item so that we may inform you what return postage costs you are entitled to and so that we know to expect your Item back. Please also refer to our return postage estimate details below. Please also note that no clothing Items qualify for any refund for return postage.
Please note that we are not obliged to offer return postage costs. However, the British Red Cross eBay shop may reimburse postage costs where the listing contains any inaccuracies and in the following cases:
1 Not working when stated as 'working'
The Item must have been properly tested by you and have originally been stated as 'working' or in an excellent, very good or good condition without any condition specifics contradicting the part of the Item you are referring to as not working. Please note all Items are re-tested when they arrive with us and if we find your Item to be working, we will have the Item externally assessed and will not refund return postage costs where the specialist concludes that the Item is working in their report. Your entitlement to a full refund of Item and original postage costs will not be affected. Please note untested Items or Items not mentioning a working state, will not be entitled to a return postage refund.
2 Wrong size or compatibility stated in listing
Return postage will be refunded only if the listing is deemed inaccurate or misleading. Please note that there must be a contradiction between the listing and the Item received.
3 Condition inaccurately described
Please note that this only applies to missed condition specifics, errors that are not stated in the listing or where an Item has been listed as 'excellent' or 'very good' by mistake (as it is not in such a condition). If the listing states the error but you deem it to be worse than stated, please be aware that such specifics will be investigated properly to ensure a fair outcome for both parties. Please note that this may mean you are not entitled to return postage costs and thus we recommend contacting the customer service team prior to returning your Item to avoid potential disappointment.
Customs Problems during Returns
Unfortunately the British Red Cross eBay shop is not liable for any problems encountered during returns with customs that are not the result of a problem caused directly by us. You must comply with all applicable laws and regulations of the country for which the Item is destined before returning an Item to us as you are responsible for your Item's safe return to us. We will not be liable or responsible if you break any such law. Please note this means that we do not accept responsibility for any charges or extra charges and will not issue compensation due to custom related issues where it is not directly our fault (i.e. a problem caused directly by a customs form completed by us at our premises). We apologise for any inconvenience or disappointment this may cause.
Refunds without Item Return
As the happiness of our customers is important to us, the British Red Cross eBay shop is happy to offer refunds or partial refunds where applicable and in accordance with eBay selling and buying policies and with the following provisions. We prefer Items to be returned to us but understand that sometimes you wish to keep your Item and it is cheaper for both parties that you keep your Item. Please note that refunds without Item return will only be processed in the following cases:
1 Where your Item has been inaccurately described and photographic evidence of our error has been supplied. Please note that for all Items, this includes a clear photo displaying the error and a clear photo of the Item with original packaging. Your Item must have been bought for £10.00 or less to qualify for a full refund and not a partial refund.
2 Where your Item has been lost and the buyer has waited either fifteen (15) days for UK mail or thirty-five (35) days for worldwide mail and where you have supplied a declaration of non-receipt of your Item as in the following example: “I, [INSERT FULL NAME] declare that I and no one on my behalf and no one at the delivery address has received a [INSERT ITEM DESCRIPTION] (eBay Item no: [INSERT ITEM NUMBER]) from British Red Cross Shops and confirm that I am happy for them to launch a lost parcel investigation into the whereabouts of this named Item. I understand that this is a legal declaration of non-receipt."
Collect In Store Items - Returns
We want our customers to be happy and thus returns are accepted on all 'collect in store' Items within twenty-eight (28) days of auction end. Unless your Item is faulty or not as described, you will be responsible for returning your Item to the applicable Store and for messaging the British Red Cross eBay team when drop off has been completed. Where a collection has been booked by you against our advice or without approval, you will also be liable for return postage organisation and costs
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Contract.
We only supply the Items for domestic and private use. You agree not to use the Item for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We do not in any way exclude or limit our liability for:
death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);
any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples); and
defective products under the Consumer Protection Act 1987.
For the purposes of this Agreement, “Force Majeure” means an event or circumstance which is beyond our reasonable control which includes, but is not limited to strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
If a Force Majeure event takes place that affects the performance of our obligations under a Contract:
we will contact you as soon as reasonably possible to notify you; and
our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Force Majeure event. Where the Force Majeure event affects our delivery of Items to you, we will arrange a new delivery date with you after the Force Majeure event is over.
You may cancel a Contract affected by a Force Majeure event which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Items you have already received and we will refund the price you have paid, including any delivery charges.
Other important terms
We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.
You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
This Contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
These Terms are governed by English law. This means a Contract for the purchase of Items through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
